Agreement to Terms
By accessing or using the Orthia AI platform and services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our Services.
Description of Services
Orthia AI provides an AI-powered receptionist platform designed for orthodontic practices. Our Services include automated call answering, appointment scheduling, insurance verification, patient communication management, and related features as described on our website.
Subscription and Billing
- Services are provided on a monthly subscription basis at the rates published on our pricing page or as agreed in your service agreement.
- Payment is due monthly in advance. We accept major credit cards and ACH transfers.
- Prices may change with 30 days written notice.
- You may cancel your subscription at any time with 30 days notice. No refunds are provided for partial months.
Practice Responsibilities
- Providing accurate practice information during onboarding
- Maintaining valid PMS credentials for integration
- Reviewing and approving AI configuration settings
- Complying with all applicable healthcare regulations
- Notifying Orthia of any changes to practice information
HIPAA and Compliance
Orthia maintains HIPAA compliance for all patient data handling. A Business Associate Agreement (BAA) is executed with every practice during onboarding and forms part of these Terms. Both parties agree to handle Protected Health Information (PHI) in accordance with HIPAA requirements.
Limitation of Liability
Orthia AI is a communication assistance tool and does not provide medical advice. The platform is designed to facilitate patient scheduling and communication, not to diagnose, treat, or make clinical decisions. Practices retain full responsibility for clinical care and medical decisions. Our liability is limited to the fees paid for the Services in the 12 months preceding any claim.
Intellectual Property
All intellectual property rights in the Orthia platform, including software, algorithms, designs, and documentation, remain the exclusive property of Orthia AI. Your practice data remains your property at all times.
Termination
Either party may terminate the subscription with 30 days written notice. Orthia may suspend services immediately if required by law or in cases of material breach. Upon termination, your data will be available for export for 90 days, after which it will be securely deleted.
